Estate Planning · Probate · Business Formation

Experienced counsel, one client at a time.

I help families and small business owners in Butler County and the surrounding area put their affairs in order: wills and trusts, the settling of estates, and new businesses done right from the first filing.

Practice areas

Three kinds of work, done thoroughly.

Most clients come to me for one of these three things. Each has its own set of Pennsylvania rules, and getting the details right the first time is the whole point.

Estate Planning

A plan that says who gets what, who is in charge, and who speaks for you if you cannot speak for yourself. Written for your family, not for a form book.

  • Wills and codicils
  • Revocable and irrevocable trusts
  • Durable financial powers of attorney
  • Health care powers of attorney and living wills
  • Deeds and beneficiary designations that match the plan
  • Planning for long-term care and Medicaid eligibility

Worth knowing: Pennsylvania has no estate tax, but it does have an inheritance tax, and the rate depends on who inherits. A plan should account for it.

Probate & Estate Administration

When someone has died, I guide the executor or administrator through the process at the Register of Wills and see the estate through to a final accounting and distribution.

  • Opening the estate and obtaining letters
  • Notices to beneficiaries and creditors
  • Inventory and valuation of assets
  • Pennsylvania inheritance tax return (REV-1500)
  • Sale or transfer of real estate from the estate
  • Family settlement agreements and final distribution

Worth knowing: Inheritance tax paid within three months of the date of death earns a 5% discount. Getting started early saves the estate money.

Business Formation

Setting up a new business so the paperwork protects the owners, the taxes are handled correctly, and the ownership rules are written down before there is a disagreement.

  • Limited liability companies (LLCs) and corporations
  • Operating agreements and bylaws
  • Pennsylvania Department of State filings and registrations
  • Buy-sell and ownership transfer provisions
  • Transfers of a family business or farm to the next generation
  • Contracts, leases, and general counsel for small businesses

Worth knowing: Filing the Certificate of Organization is the easy part. The operating agreement is what matters when an owner retires, divorces, or dies.

Not what you need?

To do these three things well, I do not take other kinds of cases. If you need help with another area of the law, I am not able to provide referrals, but the Pennsylvania Bar Association Lawyer Referral Service can connect you with a lawyer who handles it.

How I work

What to expect when you call.

Call or book a time online

Call (724) 406-0616 or pick an open appointment on the booking page, and tell me in a sentence what you need. We will meet at 164 S. Main Street, or by phone if that is easier. The first meeting is about understanding your family, your property, and what you are trying to accomplish. Bring whatever documents you already have.

A clear fee, in writing

Before any work begins you will know what it will cost and what is included, in a written fee agreement.

Documents you understand

I walk through every document with you before you sign it, handle the signing and witnessing properly, and tell you what to keep where.

About the attorney

Joseph J. Nash, Esquire

I grew up in Pennsylvania, earned a Bachelor of Science in Biology from the University of Kansas in 2001, and graduated from the Penn State Dickinson School of Law in 2007. I began my career as an Assistant District Attorney in Cameron County, Texas, trying cases in the courtroom every week. In 2009 I moved home to Pennsylvania and have practiced here ever since.

My practice is built around the legal needs of families and small businesses in Butler County and the neighboring counties: planning estates, settling them, transferring real estate, and setting up and advising businesses.

It is a one-lawyer office on purpose. The person you meet with is the person who does the work, and I see your matter through from the first meeting to the last signature.

I am admitted to practice before the courts of the Commonwealth of Pennsylvania.
